>>> now rapid fire response from the panel on these stories. supreme court justice antonin scalia says the constitution doesn't protect women from discrimination. in a legal magazine, he said 194th amendment does not apply sex discrimination . i guess we are not all created equal after all, huh?

>>> and john boehner 's trying to -- what is he trying to do fix his reputation? good luck. this morning, well, he had chief justice roberts swear in his staff. and tonight, he is skipping a ritzy fund raising republican party for freshmen. tan man, you can't fool us. with us tonight, karen hunter , journalist and publisher. also with us tonight, heidi harris , radio talk show host out of las vegas and we got to say, she is the aught over the new book, " cocktail waitress wisdom, life lessons learned while carrying a tray in las vegas ."

>> heidi is that you on the front cover back in the day?

>> that's me -- you know, that is actually me pretty recently with a real bad wig on, i couldn't afford a model, ed. fish nets are great.

>> now, you were a cocktail waitress in las vegas , right?

>> years ago, yes i was.

>> how in the heck did you ever become a republicanen? you were working thought for a living, working hard them don't like you workers out there?

>> you know, because i'm a hard worker, i understand the value of a dollar. thatve.

>> karen hunter , great to have you with us tonight as well. this comment by mr. scalia from the supreme court , how troubling is this, in your opinion?

>> i guess in scalia 's world, plessy versus ferguson should have been withheld and labor isry shouldn't have been abolished. he is there for life with clarence thomas and a few other questionable characters, we have a president of the united states willing to appoint people to balance the scales and i believe the supreme court should look like america so, i'm happy that sotomayor is there to fight the good fight and elena kagan there to fight the good fight and a few others been there before them to fight the good fight, he very disturbing we have someone sit october bench who believes that women should not be treated equally in america in 2011 . wow.

>> he was asked by a print journalist about the 14th amendment and he said, "if indeed the current society has come to different views that's fine. do you not need the constitution to reflect the wishes with of the current society. certainly, the constitution does not require discrimination on the basis of sex. the only issue is whether it prohibits it. it doesn't." heidi , your take?

>> i think he is very clear about that he is not saying that women don't have rights. he is saying legislatures do whatever they want to i don't see it in the 14th amendment , anything about women mentioned. it ast equal protection . i don't have a problem with what he said. i think i love him.

>> my tongue just bled from me biting that especially during that earlier exchange but heidi , at the end of the day if this man is sit october court that mean it is you're waitressing and a man is also in your restaurant, that he has more rights than you do under scalia 's what he just said.

>> no, no, no, that is what you are missing that.

>> he didn't say it he implied.

>> no did he not say that he stayed is not in the constitution . see, conservatives will say legislatures can do what they want to the constitution says this. liberals will say i, as a judge, am going to interpret the constitution anyw way i want to for my own political gain. he didn't say the states don't have rights to pass laws , he stayed is not in the constitution .

>> things not in the constitution i was three-fifths a man of one point, that wasn't me in the constitution to be treated equally in this country. thank god we have people on the courts using good common sense and humanity to -- excuse me, to interpret the laws.

>> that is why what the 14th amendment was supposed to remedy, a lot was about reconstruction, as you very well know and it remedied it to a large extent there is nothing about women in there.

>> karen hunter , heidi harris , great to have you with us tonight t is a hot topic and i was surprised by the comment myself.
